In March 2024, the U.S. Environmental Protection Agency (EPA) finalized sweeping updates to the NESHAP rules for EtO sterilization. These new regulations aim to reduce overall emissions by 90%, with a focus on both stack emissions and fugitive leaks.

Approximately 90 commercial sterilization facilities across the U.S. are affected, and many will need to retrofit, add to, or replace legacy abatement systems to stay in operation. Compliance isn’t optional, and the deadline is fast approaching.

As of January 14, 2025, the Federal Insecticide, Fungicide and Rodenticide Act (FIFRA) regulates the exposure of workers to Ethylene Oxide in commercial sterilizers and other related facilities. Under FIFRA, the EPA has released an Interim Decision aimed at significantly reducing EtO in air to protect workers in sterilization facilities. These requirements include:

Lowered worker exposure limits over an 8-hour Time-Weighted Average (TWA):
- < 1 ppm by 2026
- 0.5 ppm by 2028
- 0.25 ppm by 2030
- 0.1 ppm by 2035

Mandatory measures such as continuous monitoring of EtO levels, respirator use in high-risk areas, and separation of HVAC systems to reduce exposure.
